About the Law Office of Andrew Weisfeld

The Law Office of Andrew Weisfeld is a solo practitioner firm practicing special education law and immigration law.  Mr. Weisfeld is a licensed attorney in New York state and New Jersey who received his Juris Doctor degree from Fordham University School of Law.  In addition to his law practice, Mr. Weisfeld currently holds positions as a supervising attorney at Lincoln Square Legal Services in Manhattan, a Legal Consultant at Montefiore Medical Center, and adjunct professor at Fordham University School of Law, and spent approximately three years as a special education litigation attorney with the Cuddy Law Firm in White Plains, New York.  Mr. Weisfeld is a determined litigator with years of special education law experience and has successfully litigated numerous preschool, elementary school, middle school, and high school special education cases against the New York City Department of Education and Westchester County school districts.    Prior to attending Fordham University School of Law, Mr. Weisfeld received two Master's Degrees in education and received his Bachelor of Arts degree from Haverford College in Haverford, Pennsylvania.  In addition, Mr. Weisfeld spent eight years working as a school and community counselor in Westchester County prior to commencing his legal career.  Throughout his legal career, Mr. Weisfeld primarily assisted clients of limited means and income level.  The Law Office's mission is to continue to serve families in need against governmental agencies.  Regardless of income level or economic means, please contact the Law Office today to find our how Andrew Weisfeld can help you and your family.

Special Education Law

Free and Appropriate Public Education:

Under the Individuals with Disabilities Education Act and New York State Commissioner's Education Regulations, students with disabilities, ages three to twenty-one, have the right to receive a free and appropriate public education that ensures meaningful educational progress.

Individualized Education Program:

To ensure that students with disabilities make meaningful educational progress, a school district may be required to develop an educational program individually tailored to meet the Student's unique needs.  The individualized education program must describe the Student's unique needs and abilities and include goals and supports that are reasonably calculated to allow for meaningful educational progress. 

Due Process:

A school district may fail to appropriately evaluate a student with a disability, fail to develop an appropriate individualized educational program, fail to implement the individualized educational program, fail to secure an appropriate educational placement, in addition to other possibilities that would result in a student with a disability being unable to make meaningful educational progress.  Educational regulations afford the parent of a student with a disability the right to bring forth a due process proceeding against a school district in order to ensure the student's right to a free and appropriate public education.  A parent of a student with a disability may wish to seek legal representation prior to commencing a due process proceeding against a school district.  If you are the parent of a student with a disability, contact our office today to find out more about your rights.

Fee Shifting:

The Individuals with Disabilities Education Act includes a fee-shifting provision which awards reasonable attorneys' fees to a prevailing party who is a parent of a child with a disability.  Contact our office today to discuss how the fee-shifting provision can allow families of all income levels to afford legal representation.
